Welcome to GhostTrace™. These Terms of Use ("Terms") govern your access to and use of the GhostTrace™ mobile application and related services (collectively, the "Service"), owned and operated by Host by NOLA LLC ("Company," "we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms.

Acceptance of Terms & Age Requirement

By creating an account or using GhostTrace™, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, do not use the Service. You must be at least 13 years of age (or the age of digital consent in your jurisdiction) to use this Service. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

Electronic Signature Consent (E-SIGN Act & UETA)

GhostTrace™ offers electronic signature functionality. By using the e-signature feature — either to request signatures from others or to sign a document yourself — you consent to use electronic signatures and electronic records as legally valid under the U.S. Electronic Signatures in Global and National Commerce Act (E-SIGN Act, 15 U.S.C. § 7001) and the Uniform Electronic Transactions Act (UETA).

You acknowledge and agree that:

  • Your electronic signature has the same legal effect as a handwritten signature
  • Electronic records and audit certificates are legally valid and enforceable
  • You may request a paper copy of any signed document at no charge by contacting legal@hostbynola.com
  • You may withdraw your consent to electronic signatures by discontinuing use of the signing feature
  • Each signature is recorded with a timestamp, approximate location, and device fingerprint for audit purposes

This consent applies to all documents you sign or request signatures for through GhostTrace™. Signatures involving wills, trusts, family law matters, court orders, or notices of utility termination may be excluded from E-SIGN Act coverage under 15 U.S.C. § 7003 — consult legal counsel for such use cases.

Description of Service

GhostTrace™ provides file tracking and monitoring services that allow users to:

  • Upload and share files with tracking enabled
  • Monitor file access, screenshots, and forwarding activity
  • Receive real-time notifications of file interactions
  • Manage recipients and access permissions
  • Generate audit trails and activity reports

User Responsibilities

You agree to:

  • Use the Service only for lawful purposes
  • Not upload illegal, infringing, or harmful content
  • Maintain the security of your account credentials
  • Not attempt to bypass tracking or security features
  • Not reverse engineer or attempt to access the Service improperly
  • Respect the privacy and rights of file recipients

Prohibited Uses

You may NOT use the Service to:

  • Distribute malware, viruses, or harmful code
  • Share copyrighted material without authorization
  • Transmit spam, phishing, or unsolicited communications
  • Harass, threaten, or harm others
  • Violate any applicable laws or regulations

Intellectual Property

The Service and its original content, features, and functionality are owned by Host by NOLA LLC and are protected by international copyright, trademark, and other intellectual property laws. © 2026 Host by NOLA LLC. All rights reserved. You retain ownership of files you upload but grant us a license to store and process them for the purpose of providing the Service.

Disclaimer of Warranties

The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, secure, or error-free. Tracking features depend on recipient device behavior and may not detect all interactions.

Limitation of Liability

To the maximum extent permitted by law, GhostTrace™ shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to loss of data, business interruption, or unauthorized file access.

Indemnification

You agree to indemnify, defend, and hold harmless GhostTrace™ and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses arising from your use of the Service or violation of these Terms.

Termination

We may terminate or suspend your access to the Service at any time, with or without cause, with or without notice. You may terminate your account at any time by deleting it through the Settings page.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Louisiana, United States, without regard to conflict of law provisions. Any disputes shall be resolved exclusively in the courts located in Orleans Parish, Louisiana.

Binding Arbitration

By using this Service, you agree to resolve any disputes through binding arbitration rather than court proceedings. This means you waive the right to participate in class action lawsuits.

Arbitration shall be conducted through the American Arbitration Association (AAA) in New Orleans, Louisiana, in accordance with AAA's Consumer Arbitration Rules. Judgment on the award may be entered in any court with jurisdiction.

This arbitration agreement does not prevent you from bringing individual claims in small claims court or filing complaints with government agencies.

DMCA Copyright Notice

Host by NOLA LLC respects intellectual property rights. If you believe content violates your copyright, submit a DMCA notice to legal@hostbynola.com with:

  • Description of copyrighted work
  • URL of infringing content
  • Your contact information
  • Statement of good faith belief
  • Your electronic signature

We respond to all valid DMCA notices within 24-48 hours. Repeat infringers will have their accounts terminated.

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or in-app notification. Continued use of the Service after changes constitutes acceptance of the new Terms.
